VIVIDUS RUST VIPサービス 利用規約

本利用規約（以下「本規約」といいます。）は、VIVIDUS（以下「当運営」といいます。）が提供する「VIVIDUS RUST VIPサービス」（以下「本サービス」といいます。）の利用条件を定めるものです。
本サービスを購入・利用された方（以下「利用者」といいます。）は、本規約に同意したものとみなします。

第1条（サービス内容）
本サービスは、オンラインゲーム「RUST」内において、VIVIDUSが運営するサーバ（以下「VIVIDUS RUST」）上で提供されるVIP向けサービスです。
本サービスの具体的な内容、提供条件、提供期間等は、当運営が別途定める商品ページに記載された内容に従うものとします。
利用者は、購入前に必ず商品ページの内容を確認し、理解した上で本サービスを購入するものとします。

第2条（購入および利用資格）
本サービスは、当運営が指定する商品ページから正規に購入した利用者のみが利用できます。
利用権は、購入者本人にのみ帰属し、第三者への譲渡、貸与、売買、名義変更等は禁止します。

第3条（サービス提供期間）
本サービスの利用期間は、商品ページに記載された期間とします。
利用期間は、サーバの稼働状況等により、開始日時または終了日時が前後する場合があります。

第4条（サービス内容の変更）
当運営は、必要と判断した場合、本サービスの内容を利用期間中であっても変更、追加、または削除することができます。
サービス内容の変更により、利用者に不利益または損害が生じた場合であっても、当運営は返金、補償その他一切の責任を負いません。

第5条（SLA：稼働率保証）
本サービスの月間稼働率は、90%を目標とします。
稼働率が1か月あたり90%を下回った場合、当運営は返金に代わる対応として、停止期間相当分の利用期間延長を行います。
稼働率の算定方法および停止時間の判断は、当運営の基準により行うものとします。

第6条（返金不可）
本サービスは、いかなる理由があっても返金には応じません。
サーバ障害、仕様変更、サービス内容の変更、利用者の環境不具合、利用者都合による未利用等があった場合でも、返金は行いません。

第7条（禁止行為およびBAN対応）
利用者が以下のいずれかに該当する行為を行った場合、当運営は、事前の通知なく、当該利用者のアカウントをBAN（利用停止）することができます。
　・VIVIDUS RUSTのルールに違反する行為
　・不正行為、バグ・グリッチの悪用
　・他の利用者や運営に対する迷惑行為、誹謗中傷
　・その他、当運営が不適切と判断する行為
BANとなった場合でも、VIPサービスの残存期間にかかわらず、返金や期間延長等の対応は行いません。
BANの判断基準は、VIVIDUS RUSTのルールおよび当運営の裁量に準拠します。

第8条（免責事項）
当運営は、本サービスが常に完全・安全・正確に提供されることを保証するものではありません。
本サービスの利用に関連して利用者に生じた損害について、当運営は一切の責任を負いません。ただし、当運営の故意または重過失による場合を除きます。

第9条（規約の変更）
当運営は、必要に応じて本規約を変更することができます。
規約変更後に本サービスを利用した場合、変更後の規約に同意したものとみなします。

第10条（準拠法および管轄）
本規約は、日本法を準拠法とし、本サービスに関連して生じた紛争については、当運営の所在地を管轄する裁判所を専属的合意管轄とします。

VIVIDUS RUST VIP Service Terms of Use

These Terms of Use (“Terms”) set forth the conditions for using the “VIVIDUS RUST VIP Service” (“Service”) provided by VIVIDUS (“Management,” “we,” “us,” or “our”).
By purchasing or using the Service, you (“User”) are deemed to have agreed to these Terms.

Article 1 — Service Description
The Service is a VIP service provided within the online game RUST on the server operated by VIVIDUS (“VIVIDUS RUST”).
The specific details, conditions, and service period of the Service shall be as described on the product page separately designated by Management.
Users must review, understand, and agree to the contents of the product page before purchasing the Service.

Article 2 — Purchase and Eligibility
The Service may only be used by Users who have properly purchased it through a product page designated by Management.
The right to use the Service belongs solely to the purchaser. Transferring, lending, selling, assigning, or changing the registered name of the Service to any third party is strictly prohibited.

Article 3 — Service Period
The service period shall be the period stated on the product page.
The start or end time of the service period may change depending on server operating conditions or other circumstances.

Article 4 — Changes to the Service
Management may, when deemed necessary, change, add, or remove any part of the Service, even during an active service period.
Even if such changes result in disadvantage or damage to the User, Management shall not be liable for any refund, compensation, or other responsibility.

Article 5 — SLA: Availability Target
The monthly availability target for the Service is 90%.
If the monthly availability falls below 90%, Management will extend the User’s service period by an amount equivalent to the downtime, as an alternative to a refund.
The method of calculating availability and determining downtime shall be based on Management’s own standards.

Article 6 — No Refunds
The Service is non-refundable under any circumstances.
No refunds will be provided for server issues, specification changes, changes to service content, problems with the User’s environment, non-use due to the User’s own circumstances, or any other reason.

Article 7 — Prohibited Conduct and Bans
If a User engages in any of the following conduct, Management may ban or suspend the User’s account without prior notice:
Violation of VIVIDUS RUST rules
Cheating, unauthorized behavior, or abuse of bugs or glitches
Harassment, nuisance behavior, defamation, or abusive conduct toward other Users or Management
Any other conduct that Management determines to be inappropriate
If a User is banned, no refund, service period extension, or other compensation will be provided, regardless of the remaining VIP service period.
Ban decisions shall be made in accordance with the rules of VIVIDUS RUST and at the discretion of Management.

Article 8 — Disclaimer
Management does not guarantee that the Service will always be provided completely, safely, accurately, or without interruption.
Management shall not be liable for any damage incurred by Users in connection with the use of the Service, except in cases of intentional misconduct or gross negligence by Management.

Article 9 — Changes to the Terms
Management may change these Terms as necessary.
If a User continues to use the Service after the Terms have been changed, the User shall be deemed to have agreed to the revised Terms.

Article 10 — Governing Law and Jurisdiction
These Terms shall be governed by the laws of Japan.
Any disputes arising in connection with the Service shall be subject to the exclusive agreed jurisdiction of the court having jurisdiction over the location of Management.
